Plum Healthcare Lawsuit For Elder Abuse & Neglect in Sacramento. 

Plum Healthcare has faced a slew of Sacramento lawsuits for elder abuse and elder neglect according to Sacramento Elder Abuse Attorney Sean Laird.  They have been the subject of False Claims Act Litigation and recently were found liable for neglecting and abusing an elder – with a jury awarding more than 30 million dollars in damages.

Sacramento Post-Acute Skilled Nursing Facility – a Plum Facility in Sacramento.

Sacramento elder abuse attorney Sean R. Laird announced a Plum Healthcare lawsuit it filed on behalf of a dependent adult plaintiff and his family members that alleges dependent adult abuse and nursing home neglect at the Plum skilled nursing facility known as “Sacramento Post-Acute.” Sacramento’s Post-Acute’s care of this resident left him with a massive pressure wound, or “bedsore,” on his sacrum, caused his death.  This case is pending, despite Plum’s attempt to force the matter arbitration – which was rejected by the trial and appellate courts.

Plum Had to Paid $450,000 to Resolve False Claims Act Allegations.

Another Plum Healthcare Lawsuit in Sacramento was announced by the U.S. Attorney. Skilled nursing facility operator Plum Healthcare Group LLC and its entity Azalea Holdings LLC, dba McKinley Park Care Center have agreed to pay more than $451,439 to resolve allegations that they violated the False Claims Act – defrauding the government.

Specifically, Plum Healthcare Group agreed to resolve allegations that an employee at its McKinley Park Care Center knowingly created billing records for services that were not actually provided. According to the settlement agreement, Plum Healthcare Group then used these false records to bill Medicare, leading it to obtain Medicare reimbursements that were higher than warranted. The government also alleges that the management of Plum Healthcare Group learned of the extent of these false billings to Medicare, did not conduct an adequate investigation into this conduct, and then failed to submit a refund to Medicare for the full amount management knew had been overbilled or otherwise disclose its false billings to the government.

Plum Healthcare Hit With Huge Verdict in Sacramento Elder Abuse Case – Over $30 Million.

In addition to the state fine for fraud above, a Sacramento County jury awarded a deceased elder and his family more than $30 million dollars in a Plum Healthcare lawsuit. The award was for the Plum’s neglect and abuse and engaging in malice, oppression and fraud at one of its local nursing homes. Read about that verdict here.
